Release of Liability, Waiver of Claims, Assumption of Risks, Indemnity Agreement & Terms and Conditions

READ CAREFULLY – THIS AFFECTS YOUR LEGAL RIGHTS

SECTION 1: RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, AND INDEMNITY AGREEMENT

By participating in activities hosted by GolfOnTheGo-a mobile golf simulator experience operated by GolfOnTheGo, LLC of Marana, AZ-you (“Participant”) acknowledge and agree to the terms outlined below. This agreement applies to you and any individuals (including minors) under your care or attending the event under your responsibility.

I agree to observe and follow all posted rules, safety signage, and verbal instructions provided by GolfOnTheGo staff. GolfOnTheGo reserves the right to remove any participant who fails to follow safety guidance, without refund.

I certify that I am in good health and capable of participating safely. I understand participation carries inherent and unpredictable risks, including but not limited to: slips, falls, impact from golf balls or clubs, equipment malfunctions, reckless behavior by others, weather, acts of nature, serious injury, or death. I assume full responsibility for these risks, including those that may arise from the negligence of GolfOnTheGo.

On behalf of myself and my heirs, I release and discharge GolfOnTheGo, LLC, its owners, staff, contractors, affiliates, and agents from any and all claims related to injury, damage, or loss resulting from participation.

I further agree to indemnify and hold harmless GolfOnTheGo from any claims, damages, or losses-including attorney’s fees-resulting from my actions or the actions of individuals under my care, failure to follow rules, or damage to GolfOnTheGo property.

SECTION 2: TERMS AND CONDITIONS OF SERVICE

Safety Rules & Participant Conduct:

• One golfer in the simulator bay at a time.

• All shots must be hit from the designated striking area.

• All shots must be aimed at the screen; intentional mis-hits result in removal.

• No leaning, hanging, or touching the frame, curtains, or structures.

• No trick shots, crazy swings, or club throwing.

• No food, drinks, or gum inside the simulator bay.

• Children under 12 must be actively supervised.

• Appropriate footwear required: sneakers, golf shoes, or flat-soled shoes.

• Respect the equipment and others.

Booking & Payments:

• 50% deposit required to secure booking.

• Non-refundable if canceled within 7 days.

• Balance due 3 days before event.

• Cancellation refunds vary by timing; day-of cancellations receive no refund.

Weather & Rescheduling Clause:
GolfOnTheGo operates in a variety of outdoor and indoor environments, but guest safety and equipment protection are a priority.

If inclement weather occurs (including rain, lightning, high winds, flooding, or unsafe ground conditions):

1. Relocation Option
   If the client has an indoor, covered, or alternative space that meets simulator requirements, GolfOnTheGo will relocate and continue the event at no additional cost.

2. Weather Delay (Up to 60 Minutes)
   If conditions are expected to improve, GolfOnTheGo may hold setup or pause the event for up to one hour before making a final determination.

3. Rescheduling
   If weather prevents the event from safely moving forward and no suitable alternate space is available:

• The event will be rescheduled to a mutually agreed-upon date

• The client’s deposit will transfer to the new date with no penalty

• Rescheduled events must take place within 6 months, subject to availability

4. Non-Refundable Deposit
   All deposits remain non-refundable but will be 100% credited toward the rescheduled date due to weather-related interruption.

5. Final Authority
   GolfOnTheGo staff reserves the right to make the final call on setup, relocation, delay, or rescheduling in the interest of safety and equipment protection.

Travel & Setup:

• Travel fees apply from Marana, AZ; subject to change with fuel/maintenance costs.

• Minimum space required: 20 ft (W) x 12 ft (D) x 10 ft (H). Surface must be flat and accessible.

• Unsafe sites may result in cancellation without refund.

Liability & Cleaning:

• Participants are responsible for damage caused by negligence or misuse.

• Excessive cleaning (spills, biohazards) incurs a $250 minimum fee.

SECTION 3: LARGE-SCALE & CORPORATE EVENTS

For corporate, institutional, or public events, additional terms may apply. Hosts are responsible for necessary permits, insurance, and crowd management. GolfOnTheGo reserves the right to adjust pricing, staffing, or operations for high-traffic events.

By attending a GolfOnTheGo event, I grant permission for media use in promotional materials without compensation. I agree to receive event updates and promotional communications, with the option to opt out at any time.

This agreement is governed by Arizona law. Disputes shall be resolved by binding arbitration in Pima County, AZ, under AAA rules.
